PLEASE READ THESE TERMS CAREFULLY BEFORE MAKING A PURCHASE. BY COMPLETING A PURCHASE ON THIS WEBSITE, YOU AGREE TO THESE TERMS.
1. Introduction
These Terms and Conditions of Sale ("Terms") apply to all purchases made through the Aggressor Boutique Website located at www.aggressorboutique.com (the "Website"). These Terms form a legally binding agreement between you ("Customer") and Aggressor Adventures, LLC ("Aggressor", "we", "us", or "our"), a company registered in the State of Georgia, USA.
By placing an order, you confirm that you are at least 18 years of age and have the legal right to enter into this agreement.
2. Order Acceptance and Confirmation
When you place an order on this Website, you will receive an automated email confirming that your order has been received and sent for processing. This confirmation email is a receipt only. It does not mean your order has been accepted or that a binding contract has been formed.
A binding contract between you and Aggressor is only formed when the purchased item is delivered to you.
We reserve the right to refuse or cancel any order at any time before delivery for any of the following reasons:
- The product or price listed contains an error (see Section 4 below)
- We are unable to verify payment or billing information
- The order violates these Terms in any way
If we cancel your order before delivery, we will issue a full refund of any amount already charged to your payment method.
3. Pricing
We make every effort to ensure that all prices displayed on the Website are accurate. However, errors can occur. Prices are shown in US Dollars (USD) unless otherwise stated.
All prices are subject to change without notice, except for orders where a binding contract has already been formed as described in Section 2.
4. Pricing Errors
A pricing error occurs when a product is listed or sold at an incorrect price, or when a discount code or promotion is applied to a product it was not intended to cover. This includes typographical errors, system errors, or any other mistake that results in an incorrect price being charged.
In any such case, Aggressor reserves the right to cancel any order placed at the incorrect price, provided that the product or service has not yet been delivered to the Customer.
In such cases, we will:
- Notify you of the pricing error as soon as it is discovered
- Cancel the affected order
- Issue a full refund of any amount charged to your payment method within 10 business days
We will not be liable for any losses, costs, or damages arising from a pricing error, beyond issuing the refund described above.
5. Promotions and Discount Codes
5.1 General Rules
From time to time, Aggressor may offer promotional discounts, coupon codes, or special pricing ("Promotions"). All Promotions are subject to the following rules:
- Only one (1) Promotion code may be applied per order, unless explicitly stated otherwise
- Promotions cannot be combined with any other offer, discount, or Promotion unless specifically stated
- Promotions apply only to eligible products as defined by Aggressor at the time of the offer
- Promotions are non-transferable and have no cash value
- Aggressor reserves the right to withdraw or modify any Promotion at any time without notice
5.2 Birthday Promotions
Birthday Promotions, where offered, apply only to standard retail merchandise on the Website. Unless explicitly stated in the Promotion terms, Birthday Promotions do not apply to:
- Gift cards, travel vouchers, or travel credits of any kind
- Already-discounted or sale-priced items
5.3 Misuse of Promotions
Aggressor reserves the right to cancel orders or revoke discounts where we reasonably believe a Promotion has been used in a way that was not intended.
6. Gift Cards and Travel Vouchers
Travel vouchers and gift cards sold through the Website are subject to the following terms:
- Vouchers may not be purchased using discount codes, birthday promotions, or any other Promotion, unless explicitly stated
- Vouchers are non-refundable once issued and delivered to the Customer, except as required by applicable law
- Vouchers have no cash value and cannot be exchanged for cash
- Aggressor is not responsible for lost, stolen, or damaged vouchers after delivery
Vouchers are considered "delivered" when they are sent to the Customer via email or made available through the Customer's online account.
7. Refunds and Returns
7.1 General Refund Policy
Due to the customization of each item, returns or refunds cannot be accepted.
By completing a purchase on this Website, you acknowledge and agree to this policy.
7.2 Orders Cancelled Before Delivery
If Aggressor cancels an order before delivery — including cancellations due to pricing errors as described in Section 4 — a full refund will be issued to the original payment method within 10 business days.
7.3 Customer-Requested Cancellations Before Delivery
If you wish to cancel an order before it is delivered, please contact us as soon as possible. We will do our best to accommodate cancellation requests, but we cannot guarantee cancellation once an order has been processed.
8. Limitation of Liability
To the fullest extent permitted by law, Aggressor's total liability to you for any claim arising out of or related to a purchase shall not exceed the amount you paid for the relevant order.
Aggressor is not liable for any indirect, incidental, or consequential damages, including lost profits or business opportunities, arising from a cancelled or erroneous order.
9. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of the State of Georgia.
If you are located outside the United States, local laws may apply to you in addition to these Terms. Aggressor does not waive any rights under applicable local law by including this clause.
10. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this Website with a new "Last Updated" date. Continued use of the Website after changes are posted constitutes your acceptance of the updated Terms.
For purchases already completed, the Terms in effect at the time of purchase will apply.
